Hire Terms & Conditions

PTE Terms & Conditions of Hire
(PTE is a trading name of AWS Landscapes Ltd. VAT Reg No. 590 9572 01)
1.
Definitions & Law – “Plant” means the equipment hired; “Owner” is PTE; “Hirer” is the customer. Governed by the laws of England.
2.
Charges – Hire charges run from delivery until return in clean, serviceable condition. Rates quoted per 5-day week, excl. VAT. Minimum charges apply.
3.
Carriage – Delivery/collection at Hirer’s expense. Quoted rates include 30 mins loading; extra time charged.
4.
Contract Length – If Hirer is not a limited company, hire cannot exceed 3 months.
5.
Extent of Contract – Plant hired only on these terms; others excluded.
6.
Authority of Signatory – The signatory warrants authority to contract and indemnifies the Owner if not so. Hirer responsible for proper, instructed use.
7.
Delivery – Plant deemed in good order unless notified otherwise at delivery.
8.
Loading/Unloading – Responsibility of Hirer; Owner’s staff deemed Hirer’s employees when assisting.
9.
Hirer’s Responsibility – Liability starts on receipt and ends only when Owner issues receipt for full return. Plant must not be sold or sub-let.
10.
Third Party Liability – Hirer indemnifies Owner against claims for injury or property damage (including to Plant) arising from hire or use.
11.
Electrical Plant – Must be correctly earthed unless double insulated; alterations only by competent persons.
12.
Maintenance & Breakdown – Hirer must keep Plant safe/clean and report faults immediately. Repairs only by Owner.
13.
Removal of Plant – Plant not to be moved from site without Owner’s written authority.
14.
Consequential Losses – Owner not liable for indirect or consequential losses (e.g. delays, breakdowns).
15.
Loss/Damage/Unclean Plant – Hirer liable for loss, theft or damage to Plant at Manufacturer’s replacement price, and for cleaning/repair costs, except where Damage Waiver (Sec. 19) applies. Hire charges run until rectification/replacement complete.
16.
Termination of Hire – Owner may terminate at any time and repossess the Plant.
17.
Access – Owner may enter premises to inspect, test, repair, replace or repossess Plant.
18.
Validity – Invalid terms do not affect validity of remainder.

19. DAMAGE WAIVER POLICY (Optional – 15% of Hire Charges)
19.1 Overview – On payment of a Damage Waiver Fee (15% of hire charges excl. VAT), Hirer’s liability for loss/damage is limited as below. Not insurance but a contractual waiver. 19.2 Covers – Accidental damage and theft where reasonable precautions taken. 19.3 Excludes – Negligence, misuse, unsecured theft, wilful acts, fraud, loss of consumables/accessories, consequential losses. 19.4 Excess – Hirer remains liable per incident: under £1k = £50; £1k–£5k = £250; over £5k = £500. 19.5 Claims – Theft/loss must be reported immediately with crime ref. Damage must be returned promptly. Non-compliance may void cover. 19.6 General – Waiver valid only if paid in advance. Owner may amend/withdraw before hire begins. Does not limit liability for death, personal injury or fraud.
